Installation Terms & Conditions…

1. DEFINITIONS

a. ‘THE COMPANY’ refers to the the business called Eagle One Security that operated on the website URL: eagleonesecurity.co.uk and is the business responsible for the design, installation and/or maintenance of installations which is the subject of these terms. The company is sometimes referred to as ‘our’ or ‘we’ or ‘us’ within these Terms and Conditions.

b. ‘THE CONTRACT’ is the agreed and signed upon quotation or estimate and subsequent order between the company and the customer, in reference to a CCTV order, installation and/or maintenance of installations sometimes referred to as the ‘order’ which is the subject of these terms.

c. ‘THE CUSTOMER’ is the person or organisation being a signatory to any order contract placed with the company, sometimes referred to as ‘you’ or ‘your’ in these Terms and Conditions.

d. ‘THE PREMISES’ are the premises set out in the specification and will be listed in the contract order.

e. ‘THE INSTALLATION’ is the installed CCTV system as defined in the specification.

f. ‘INSTALLATION STANDARD’ is the standard according to which the equipment is to be installed and/or maintained, together with any other formal requirements stipulated as a condition of the within the order contract.

g. ‘SPECIFICATION’ means the design specification which defines the level of CCTV surveillance afforded by the security Installation.  It is an integral part of this contract.

h. ‘QUOTATION’ means the proposed price for the equipment (the package cost), its installation and/or maintenance as itemised in the contract and on the official quotation provided by the company.

i. ‘ESTIMATE’ means the estimated price for the equipment (the estimated package cost), its installation and/or maintenance as itemised in this contract and on the official quotation provided by the company. Estimates are provided when a fixed quotation cannot be given, for example if part of the order is unknown or cannot be accurately quoted at the time of the customer consultation.

j. ‘CONSULTATION’ means the initial visual inspection of the customers premises and forms the basis of the estimate, quotation and order with the company.  

k. ‘SIGN-OFF FORM’ once the agreed, specified installation is completed the sign-off form is the customers approval that the installation has been carried out to their satisfaction and must be signed before any warranty is provided by the company and/or suppliers.

2. GENERAL

The customer can accept these Terms and Conditions either by:

a. Replying via email accepting the Terms and Conditions along with other requirements defined in the estimate, quotation and / or specification sheet.

b. Following a link provided through the email sent by a company representative and accepting the terms and conditions, along with other requirements defined in the quotation and / or specification sheet.

c. However, the customer’s acceptance will not be binding on the company until a confirmation email from the company has been sent to the customer, detailing the installation schedule.

d. For the purpose of interpretation, where the requirements of the specification/quotation conflict with any clauses of these terms and conditions, the specification/quotation requirements shall take precedence. 

e. All other terms and conditions not contained in/or implied by the contract are excluded. 

f. Nothing in these terms and conditions, stated or implied, shall detract from the customer’s statutory rights.

3. COSTS

The estimated/quoted costs may be revised if:

a. You require the work to be carried out more urgently than agreed.

b. You change the specification.

c. Your premises are in some way unsuitable for the equipment and this was not apparent during the course of any initial conversation or consultation, or there are circumstances which we should have been made aware of at the time of consultation or ordering.

d. Any other special circumstances that arise and we were not aware of in writing when supplying our original estimate or quotation arise.

This includes:

e. Re-visits of the installer/technicians/engineers for re-configuration of the system.

f. Remote viewing, where the customer is responsible for the availability of a suitable broadband internet service and a router that provides the correct functionality.

g. The installation work is outside the working hours of 9.00am to 6.00pm Monday to Friday (bank holidays are excluded).  Requests made by the customer to install outside these working hours will incur additional charges.

h. If engineers are asked to work outside standard practices of installations, unless stated on the works schedule or we were made aware in writing when supplying our original quotation. Installations require easily accessible areas without the need of additional labour work or equipment outside of our standard installation equipment. This includes, but is not necessarily limited to:

  • > Underground cabling
  • > Redecoration
  • > Building work
  • > Removal of floor boards, carpet lifting / carpet laying
  • > Erecting poles
  • > Steel trunking/capping
  • > Exceptionally high ceilings/walls (greater than 4 metres)
  • > Drilling through walls thicker than 300mm

Should any of the above be required, additional charges will apply and additional contractors may be employed to carry out the work not within our scope of practice.

i. Additional charges may be made if our engineers/technicians/installers are not provided with access to doors, shutters, windows or any other areas where cables and equipment need to be installed thereby incurring extra cable length (if hard wiring is employed).

4. COMPANY’S OBLIGATIONS

a. We agree to complete the installation and hand it over in working order.  We will always seek your agreement should changes to the specification be required during installation that had not been foreseen during the consultation phase.

b.  When we commission the installation and you are satisfied with the installation, a ‘sign-off form’ will be issued for you to sign – this is your confirmation that you are happy with the installation and your warranty commences from this point.

c. We agree that, if any of our installation workmanship is found faulty within the first 30 days, it will be repaired or replaced at the company’s expense, including call-out, provided you let us know as soon as the fault occurs. Maintenance/repairs/trouble-shooting after the expiration of the 30-day period will be charged for.

5. CUSTOMER’S OBLIGATIONS

a. You agree to give our installer full access to your premises to survey, measure, install, test and service the equipment.

b. You also agree to provide an adequate electricity supply for the equipment to operate correctly (where continuous power is required/requested). 

c. If our work is interrupted or delayed because of a problem with access, or the electricity supply is inadequate, we may make an extra charge. We are not liable if completion is delayed due to ANY circumstances beyond our control.

d. By signing the contract with us, you guarantee that you have full authority to allow the installation to happen and no other consent is needed or required by law.

e. By signing the contract with us, you confirm that you are of legal age to enter into the contract, which is 18 in the United Kingdom.

f. The equipment does not belong to you until it has been paid for in full.  If you do not pay the balance of the installation charge when due, we reserve the right to remove the equipment from your premises without notice.  By signing a contract with us, you irrevocably authorise us to enter your premises to remove the equipment if payment remains outstanding. Obviously, we never want this to happen so if you have any problems paying the balance owed, please contact us immediately so we can assist.

g. If you cancel our contract less than 7 calendar days before the scheduled installation date, you may be charged for any equipment we have purchased for your premises including installation supplies. A general cancellation fee of 10% of the contracted amount shall be charged for any installations cancelled post contract agreement.

6. PRODUCT WARRANTY

a. All products are sold as new.

b. All our products are supplied with their original manufacturer’s warranty to be free of defects in workmanship and material for a of 1 year, unless otherwise specified, from the day the order is signed-off.

c. We will replace or refund items providing there is no evidence of customer misuse, alteration or damage howsoever caused.

e. You will need to provide as much information as possible regarding the fault, as well as the original invoice, proof of purchase or order number.

7. TECHNICAL (IT) ISSUES

WiFi connected products rely on a good internet connection being available in your premises as well as a strong WiFi signal at the point of installation. It is advised to pre-test your WiFi connection using your mobile phone at a point closest to where you would like your camera(s) installed to ensure good WiFi connectivity.

While fibre broadband is inevitably the fastest, standard high-speed ADSL connections with a connection speed of 40Mbps or greater should work fine, however please note:

a. If we are unable to configure remote viewing on the day of the scheduled installation due to technical issues with your broadband router, ISP unavailability or lack of details such as router IP address, user name & password then further charges may apply to revisit your premises to complete the setup.

b. We cannot be held liable for client IT issues such as change of router, failed connection, change of Internet service provider, reset of router, mobile phone update, loss of settings on the router or a new operating system post installation.

8. LIABILITY

a. We shall not be liable for the costs of any work, repairs or replacement of equipment which results from fire, electrical power surge, storm, flood, adverse weather, accident, neglect, misuse or damage.

b. We do not warrant or represent that the operation of the installation will be uninterrupted or error free. As with any electronic device, errors can occur which may include but is not limited to, loss of connection, loss of recording, inability to remotely view, freezes and shutdowns. Most errors can be sorted with simple steps which generally include switching your router off/on, rebooting the camera, your app and your phone/pc. All cameras are supplied with apps which have full troubleshooting steps within them.

c. The company provides and installs products to assist in the security of the customer’s premises but does not thereby warranty the security of the premises, the customer, or any contents therein the premises nor is the company liable for loss or damages if the system is circumvented or neutralised by intruders, or fails to deter intruders.

d. The company does not act and shall not be deemed to act as an insurer of the customer’s premises or contents contained therein and give no warranty that by virtue of the installation of the system, the property or contents contained therein are completely secure or inviolable.

e. The company shall have no liability in contract for any loss suffered and in particular the company does not accept any liability whatsoever for any consequential loss or damage (including loss of earnings or profits) which may arise from any malfunction or defect of the system.

f. The terms and conditions given in this contract do not affect your rights under the sale of goods act or unfair contract terms act.

9. RIGHT OF ASSIGNMENT

The company shall be entitled to assign all or any of its rights under this agreement and to perform any of its obligations through sub-contractors. the customer’s rights under this agreement are not assignable or transferable with the prior written consent of the company.

10. FORCE MAJEURE

Any failure by the company to fulfil any of its obligations under the terms of this contract due to reasons beyond its control shall not be considered a breach of this contract.

11. APPLICABLE LAW

This contract is governed by the laws of England and Wales, Scotland or Northern Ireland as the case may be and each party submits to the jurisdiction of the courts thereof.
